Website Hosting Agreement
These Terms and Conditions govern the website hosting services provided by EcoHosting Solutions Pvt Ltd, trading as Ecowebzim Solutions. By placing an order or continuing to use our services, you accept the obligations and responsibilities set out below.
Background & Agreement
These Terms and Conditions govern the provision of website hosting services provided by EcoHosting Solutions Pvt Ltd trading as Ecowebzim Solutions. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon indicating acceptance and completing your order for the service.
By submitting an order you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
The Contract between you and Ecowebzim commences upon acceptance of your order and remains in effect for as long as you receive hosting services from us.
These Terms apply to all hosting packages and associated services listed on https://www.ecowebzim.com.
Definitions & Interpretation
Unless the context otherwise requires, the expressions below have the meanings assigned to them for the purpose of this agreement.
Account
Your details required and held by us to facilitate provision of the Service, including identification and location details, username and password, and details of the Service provided.
Business Day
Any day (other than Saturday or Sunday) on which ordinary banks are open for their full range of normal business in Zimbabwe.
Client Website
The website that we host for you, including all component files and related services such as email.
Confidential Information
Information disclosed by either Party to the other pursuant to or in connection with the Agreement, whether oral, written, or in any other medium, and whether or not marked confidential.
Contract
The legally binding agreement formed between you and Ecowebzim upon acceptance of these Terms and completion of your Order.
Fee
The sum(s) payable by you to us for the Service.
Hosting Hardware
Computer and networking equipment used by us in providing the Service, including servers and network infrastructure.
Hosting Package
The hosting package selected by you, referring to specific features such as tools, facilities, storage limits, and duration.
Hosting Software
Any software used by us in the provision of the Service, including that which may be used by you.
Intellectual Property Rights
Copyright and related rights, designs, patents, trademarks, and all other intellectual property rights, whether registered or unregistered, including applications, renewals, or extensions.
Order
Your order for the Service as completed via our website specifying Account details, chosen Hosting Package, and applicable add-ons.
Service
All components of our website hosting service provided in accordance with your chosen Hosting Package.
Data Protection Legislation
EU Regulation 2016/679 General Data Protection Regulation (“GDPR”).
General Terms
The following conditions govern domain registration, service delivery, liability, and related obligations. These apply to all subscribers and authorised users of Ecowebzim services.
Domain registration is subject to availability and the policies of the relevant naming authority (ICANN or regional authorities). Registration fees are non-refundable even if a request is refused.
We accept no liability for disputes over domain ownership. In the event of a dispute, we may withhold, suspend, or cancel the domain name and make representations to the relevant authority at our discretion.
Services may be suspended if fees remain unpaid. We may refuse service, or terminate the Agreement, for breach of these Terms or in cases of insolvency.
Upon termination or suspension, we may block your website, remove or delete data, and, at our discretion, retain data temporarily subject to settlement of outstanding fees.
Ecowebzim is not responsible for any damages your business may suffer. We disclaim implied or written warranties, including merchantability or fitness for a particular purpose.
Refund Policy
All services rendered by Ecowebzim are non-refundable. This includes setup fees, one-time fees, monthly service fees, upgrade fees, additional service fees, administrative fees, and late fees. Customers agree not to charge back or dispute payments for services rendered. Chargebacks incur a $150 fee, result in immediate service termination, and may be referred to collections. Excess funds received are applied as account credit only.
Delivery of Services
Upon successful payment you receive an automated receipt. Retain it for reference. Delivery is electronic via email using the address supplied during signup. We aim to provision services immediately after signup and respond to enquiries within 24 hours. We do not add charges based on payment method, and may perform additional verification by telephone, SMS, or other fraud detection systems.
General Policies
Services are provided to authorised subscribers only. These Terms apply to all persons accessing services via your account. You are responsible for compliance by employees, agents, or customers. Misuse or abuse of cPanel, email, FTP, or other resources may result in additional charges or service suspension. The Service is provided for as long as you comply with these Terms; we reserve the right to terminate for violations.
Acceptable Usage Policy
Ecowebzim hosting resources are optimised for serving web documents and related email/FTP services. The following requirements support fair usage across our shared infrastructure.
Resource Usage
- Resources must not be used as offsite storage, third-party email provisioning, or unrelated file hosting.
- Downloadable files must relate to the website and be accessible via HTML. Illegal content is strictly prohibited.
- Shared and reseller accounts must operate within CloudLinux limits (CPU, memory, entry processes, I/O) and avoid adverse impact on server performance.
- VPS users must upgrade if resource usage adversely affects service stability.
Prohibited Actions
- Running unattended server-side processes, IRC-related software, BitTorrent, gaming servers, or cron jobs under 15 minutes.
- Exceeding 300,000 files on Linux plans or using hosting as a dedicated backup service.
- Hosting illegal or infringing content, warez, nulled software, proxies, spam tools, or high-risk services without approval.
- Any activity that exceeds fair-use thresholds, interferes with other users, or breaches applicable laws.
In cases of excessive usage or fair-use breaches, you may be asked to remove content, reduce usage, or migrate to a dedicated service. We reserve the right to warn, suspend, or cancel accounts that compromise system integrity.
Ecowebzim enforces a zero-tolerance stance on Unsolicited Commercial Email (spam). Violations incur administrative fees ($300 first offence, $600 second offence) and may lead to immediate termination. Research fees up to $300 per hour apply for blacklist remediation.
Grounds for Suspension & Termination
You agree to comply with these Terms and Policies. Ecowebzim may suspend or terminate your account, with or without notice, for any of the following:
- Using the Service to violate any law, infringe privacy or intellectual property rights, or engage in fraudulent, abusive, or malicious activities.
- Operating unauthorised services (mail servers, streaming, proxies), disseminating malware, engaging in denial-of-service attacks, or hosting prohibited content.
- Providing false contact details, performing chargebacks, threatening legal action, or using the Service for harassment or spam.
No bill credit is issued during suspension. On termination we may retain any fees paid as liquidated damages. You are liable for damages or loss of service resulting from violations, including costs associated with investigations or legal enforcement.
Security & Privacy
You agree not to access private areas of the Service or compromise security. Notify Ecowebzim immediately of unauthorised access or breaches. Child pornography is strictly prohibited. Copyright complaints should be sent to abuse.support@ecowebzim.com.
Liability & Warranty
Use of the Service is at your own risk. Ecowebzim does not control third-party information or guarantee the accuracy of material accessible through the Service. We provide no express or implied warranties. The Service, and any software provided, is supplied “as is, as available”. Data security and backups are not guaranteed.
Content & Overages
You are responsible for screening and controlling access to content that may be offensive. Services are suspended when disk space or bandwidth limits are reached unless alternative arrangements are made. Overages are billed at an agreed cost.
Billing & Financial Terms
Fees are outlined on the applicable service pages and billed in advance unless usage-based. Promotional pricing may not recur. Third-party fees and setup charges are non-refundable.
- Invoices for renewals are generated 7 days before the end of term. We attempt to charge stored cards no sooner than 2 days before the due date; ensure payment methods remain valid.
- Overdue invoices incur a late fee of 10% (minimum $2). Services are suspended after 5 days of non-payment and terminated after 30 days. Reactivation after termination incurs a $5 fee if restoration is possible.
- Overdue balances may affect all linked services. Billing disputes must be raised via ticket within 25 days of payment.
Consultants & Account Ownership
Consultants may resell hosting to clients but must not register domains using personal details. Repeated violations may result in suspension. Clients may reclaim services directly from Ecowebzim upon verification if consultants fail to pass on payments, become unreachable, or misrepresent our services.
Cancellation & Termination
Submit cancellations through the client area (Billing & Accounting ticket) at least 7 days before renewal. All PayPal or card subscriptions must be cancelled by you. Late cancellation requests (after invoice generation) incur fees between $15 and $100. Lack of payment or communication within 30 days results in termination and data deletion; a temporary backup is retained for 14 days and restoration fees apply. Domains remain active until expiration.
Migrations & Backups
Complimentary migrations are offered based on plan type (1 account for shared/semi-dedicated, 50 for reseller, 100 for managed VPS, 200 for managed dedicated). Additional migrations cost $2 per account. Services are provided as-is without guarantees on migration timelines. Nightly backups are performed for shared, semi-dedicated, and reseller servers for administrative purposes only; always maintain your own backups. Dedicated servers are not backed up by Ecowebzim unless a paid addon is purchased.
Final Provisions
Disputes: Unresolved disputes must be submitted for binding arbitration. Overages for disk space or bandwidth are charged at agreed rates.
Account Claims: Clients may claim services directly from Ecowebzim if consultants fail to update payments, become unreachable, or otherwise impede service. Identification may be required to transfer ownership.
Amendments: Ecowebzim may amend these Terms and Policies at any time by posting updates on the service. Continued use of the Service constitutes acceptance of amended terms. If you do not agree with changes, you must notify us and discontinue the Service.
